Planning Appeal Win for an Extension in Broadstairs, Kent

We are delighted to have won an appeal against Thanet District Council for extensions to an existing home in Broadstairs, Kent.

The appeal was allowed and planning permission is granted for the erection of two storey front and rear extensions together with 4 roof lights, front flat roof porch and first floor rear balcony.

Non-Determination Planning Appeal

The was made for non-determination. The appeal follows the Council’s failure to determine the application within the application timescales. The applicant grew frustrated by the Council during the application process, as there appeared to be no urgency to make a planning decision. As such, they decided to appeal the application.  

The Main Planning Issues for Consideration at the Planning Appeal

There are a few issues raised in relation to this appeal by neighbouring residents. The main issues were subsequently:

  • The character and appearance of the area; and

  • The living conditions of the neighbouring occupants, with particular regard to access to sunlight and daylight, privacy, outlook and noise.

We put forward a strong and robust planning appeal case to address these issues. For example:

  • The appeal site is a detached chalet bungalow, located in a road which is characterised by detached and semi-detached two-storey dwellings as well as bungalows of varying sizes, designs and materials. We highlighted that the proposed building works would integrate well into its surrounding context.

  • Despite objections from neighbours, we demonstrated that , it is unlikely that the appeal proposal would give rise to additional noise levels over and above what would be expected in a residential area.

  • The Planning Inspector also agree with us that the appeal proposals would not give rise to an overbearing impact upon the neighbour.
