Replacement Dwelling Granted in Basildon’s Green Belt

We have recently secured planning permission a replacement dwelling in the Green Belt. This site is located Basildon District and a few miles from Billericay.

The Planning Issue: Green Belt Housing

The application site is identified as being within Green Belt on Basildon’s adopted Proposals Map, and as such restrictive planning policies applied in the consideration of this replacement dwelling.

The National Planning Policy Framework states that the fundamental aim of Green Belt policy is to prevent urban sprawl by keeping land permanently open. It also states that the construction of new buildings as inappropriate in the Green Belt.

Despite these policy restrictions, we were able to secure planning permission for a replacement dwelling that is 40% larger than the one it is replacing!!  

One of the development exceptions set out in the National Planning Policy Framework allows the replacement of a building, provided the new building is in the same use and not materially larger than the one it replaces.

We were able to demonstrate that the 40% increase in size fell within the Green Belt policy allowances and would not be materially larger than the original dwelling. We were able to argue this as:

  • The replacement dwelling would be the same size as the existing dwelling.

  • The replacement dwelling would be more centrally located in the plot, allow for a perceived greater sense of spaciousness and openness.  

  • We had previously secured permissions for various extensions to the existing dwelling, which established a fallback position in the event that planning permission was not allowed for the replacement. The Council agreed that the fallback position was less desirable than the proposed replacement.
