Change of Use: A Dual-Use Planning Permission

The commercial property market is and will continue to face a challenging time as it seeks to adjust and respond to new conditions following the global Coronavirus outbreak. Undoubtedly many businesses will restructure or change office environments and practices.

The effect could be that commercial space may be used differently and the key moving forward will be flexibility. In this regard, Class V of Part 3 of Schedule 2 of the General Permitted Development (England) Order (2015) (Changes of Use) is not often used or even known about at the moment, but could well be used increasingly in the time ahead.

Class V of the General Permitted Development Order: Dual-Use

Class V is a mechanism to create a dual-use planning permission. In effect, planning permission is sought for the change of use to two separate planning uses that can then be used interchangeable over a 10-year period. After this time period, the authorised use will be last use on the relevant date.

A dual-use planning permission will allow much-needed flexibility at this time, particularly in the marketing of a property where it can assist in broaden the scope of potential users. A dual-use planning permission can also be helpful to businesses that are evolving or diversifying into new areas that fall within different planning uses, but want to retain the flexibility of operation and stay on the right side of planning.
